Legal
1.1 Scope. Crowded Kingdom Studios, Inc. ("CK," "we," "us," or "our") respects copyright and expects everyone who uses our services to do the same. This Policy explains how to tell us about material you believe infringes your copyright, how to respond if material you posted was removed, and what happens to accounts that infringe repeatedly. It is how we follow the Digital Millennium Copyright Act (17 U.S.C. § 512).
1.2 Where It Applies. This Policy applies to crowdedkingdoms.com, Crowdy Studio, and every game, app and world that runs on Crowded Kingdoms, wherever our servers store or carry material that someone else provided: builds, worlds, avatars, chat, voice, video, projects, mods, code, and anything else.
2.1 Ask the Host First. Many worlds on Crowded Kingdoms are run by their own developers or hosts, such as a Minecraft server that runs on our platform. The host runs and moderates its world and can usually remove material from it fastest, so if the material is in a world someone else runs, we suggest you contact the host first.
2.2 You Can Always Come to Us. You don't have to go to the host first. A notice that meets Section 4 is handled under this Policy whether or not you did. When it concerns a world someone else runs, we act on it promptly: we have the host remove the material, or we remove it or disable access to it ourselves.
3.1 Where to Send Notices. Send copyright notices and counter-notices to our designated agent:
Michael Marshall, Designated Agent
Crowded Kingdom Studios, Inc.
2410 Mesa Glen Dr, Arlington, TX 76001
hello@crowdedkingdoms.com
3.2 Registration. Our designated agent is registered with the U.S. Copyright Office and listed in its DMCA Designated Agent Directory. Email is the fastest way to reach us. If you can, start the subject line with "COPYRIGHT:" so your message reaches the right person quickly.
3.3 Other Channels. A notice sent anywhere else, such as an in-game report, a social media message or another CK address, can be delayed and may not count as notice to CK.
4.1 What to Include. Your notice must be in writing and include all of the following (17 U.S.C. § 512(c)(3)):
4.2 Think Before You Send. Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing can be liable for damages, including costs and attorneys' fees. If you are not sure whether a use infringes your copyright, for example whether it may be fair use, consider getting advice before you send a notice.
4.3 Incomplete Notices. A notice that leaves out one of these things may not be effective. If your notice identifies the work, the material and how to reach you but misses something else, we will contact you about what is missing.
4.4 What We Do. When we receive a notice that meets Section 4.1, we act promptly to remove the material or disable access to it, or have the host of the world do so. We take reasonable steps to tell the person who posted it, and we may send them a copy of your notice so that they can respond.
5.1 When to Send One. If material you posted was removed or disabled because of a copyright notice, and you believe in good faith that this was a mistake or that the material was misidentified, you can send a counter-notice to our designated agent (Section 3).
5.2 What to Include. Your counter-notice must be in writing and include all of the following (17 U.S.C. § 512(g)(3)):
5.3 What Happens Next. We send a copy of your counter-notice, including your name, address and telephone number, to the person who sent the original notice, and tell them that we will restore the material, or stop disabling access to it, in 10 business days. Unless our designated agent first hears from them that they have filed a court action seeking to stop you from infringing with that material, we restore it, or stop disabling access to it, between 10 and 14 business days after we receive your counter-notice, where it can still be restored.
5.4 Think Before You Send. Section 512(f) applies to counter-notices too: anyone who knowingly and materially misrepresents that material was removed by mistake or misidentification can be liable for damages, including costs and attorneys' fees.
5.5 Players Under 18. If you are under 18, ask a parent or guardian to help you with a counter-notice. It includes your name, address and telephone number, and we have to send it to the person who sent the notice.
6.1 Policy. We terminate, in appropriate circumstances, the accounts of people who repeatedly infringe copyright. This applies to every kind of account: players, developers, and the organizations that run worlds on Crowded Kingdoms, including the players an organization signs in.
6.2 Strikes. When we remove or disable material because of a notice that meets Section 4.1, and the removal is not reversed by a counter-notice or withdrawn by the person who sent the notice, we record a strike against the account that posted it.
6.3 Our Judgment. We may close an account after fewer strikes where the infringement is serious or deliberate, and we may decline to record a strike for a notice that was withdrawn or clearly mistaken.
6.4 Worlds Run by Others. A host is responsible for dealing with players who infringe in its world. We may also act on those players ourselves, and on a host that does not deal with repeat infringement in its world, under this Policy and our other terms.
6.5 Effect. Closing an account for repeat infringement is a termination for breach under the terms that apply to the account, and those terms govern what happens to its content and any balance. Nothing in this Section limits the rights we have under those terms.
7.1 Trademarks and Other Rights. This Policy covers copyright. For a trademark, right-of-publicity or other complaint, email hello@crowdedkingdoms.com, saying what the right is, what the material is, and where it appears.
7.2 Intimate Images and Child Safety. If someone shared an intimate image of you without your consent, you don't need a copyright notice: ask us to remove it, which carries our 48-hour removal commitment and doesn't depend on who owns the copyright. To report a child-safety concern or a player, see Safety.
We may update this Policy. A new version takes effect when it is posted, and the date at the top shows when that was.
